Terms and Conditions of Sale

By accessing this website you agree to these Terms and Conditions. This website is provided solely for your personal use. If you do not agree to be bound by these Terms and Conditions you may not use or access this website.

References in these Terms and Conditions to “Phytor” or “we” or “our” or “us” refers to Straits Biopharma Pte Ltd (UEN: 201834885E), a company incorporated in Singapore and having its registered office at 53 Mohamed Sultan Road, Singapore 238993.

 1. Your Account

1.1 You warrant that all information you provide is accurate and complete at all times.

1.2 By placing an order through our site you warrant that you are legally capable of entering into binding contracts.

1.3 Any personal data that we gather concerning you shall be used only in accordance with our Privacy Policy.

1.4 You may not use this website for any commercial purpose.

 2. Merchandise Availability

2.1 All  products are subject to availability.

2.2 In the event that an item you have chosen becomes unavailable after you have confirmed your order, we will notify you via email.

 3. Product Information

3.1 Every care has been taken to ensure that the photographic representation, description and specification of each product are accurate. However, while the reproduction of colours is a close representation, a slight variation in the actual goods may occur. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise.

 4. Order Policy

4.1 You may place an order by registering for an account on the website. You must follow the instructions on the website as to how to make your order and for making changes to your prospective order before you submit it to the Site.

4.2 Once you select a product that you wish to order, you will see the charges you must pay including GST, if applicable, and any applicable delivery charges. Unless otherwise stipulated on the website, all charges shown are in Singapore Dollars.

4.3 Full payment must be made at the time of ordering with your credit or debit card acceptable to us. You must be fully entitled to use that card and that there are sufficient funds or credit facilities to cover the cost of the Product. We reserve the right to validate your payment details before providing you with the product.

4.4 We shall not be obliged to supply the Product to you until we have accepted your Order.

4.5 We will ensure that the price given to you is accurate, but the price of your order will need to be validated by us as part of our acceptance procedure. If the price for the Order changes before we accept your Order, we will contact you and ask you to confirm that you wish to proceed at the amended price.

4.6 Receipt of our Order Confirmation email is not a contract of sale by us or acceptance of your order. An order confirmation email is issued for all orders placed online, however these are for information only.  Orders are only confirmed upon the issuance of an order invoice  from us to the buyer.

 5. Cancellation of Order

5.1 We do not accept any cancellation or modification after the order has been accepted and confirmed.

5.2 Notwithstanding that the Order has been accepted and confirmed, we reserve the right to cancel the Order or any part thereof at any time without giving you any reasons. In the event of a cancellation we will inform you via email and refund you accordingly without interest.

6. Payment

6.1 Payment for purchases on this website may be made by:

7. Fraud Protection Policy

We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order. We also reserve the right to cancel any accounts or refuse to deliver to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.

 8. Currency

All prices stated on Phytor Store are in Singapore Dollars unless otherwise stated.

9. Return & Exchange Policy

10.1 We offer a 30-day refund for all orders within 30 days of the delivery of the order. The buyer is responsible for initiating a refund by writing in to [email protected] within the refund period and send the product to the address provided by us. Upon receipt of the returned product, we will offer a full refund less any shipping fees, taxes or duties incurred by us.

10. Disclaimer of Warranties; Limitation of Liabilities

10.1 The website and the materials are presented “as is”, “as available” basis only. To the fullest extent permissible pursuant to applicable law, Phytor disclaims all warranties, express or implied, including, but not limited to, implied warranties of satisfactory quality, merchantability or fitness for a particular purpose, compliance with description or the warranty of non-infringement.

10.2 We do not warrant that the website, its content or the server(s) that make it available are error or virus free or free of other harmful components or that your use of this website will be uninterrupted.

10.3 We do not warrant that the quality of any products that you purchase through this website will meet your expectations.

10.4 Both Phytor and its delivery contractor shall not be held responsible for any damage or loss of Products after delivery. The Customer shall ensure that the Products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. The Customer expressly acknowledges and agrees that Phytor assumes no obligation or liability for any advice or information given with the Products and Phytor shall not be responsible for any inaccuracy or misstatement of any such information. The Customer assumes all risks connected with the use and storage of the Product.

10.5 In no way will Phytor be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or use thereof or inability to use by any party, or reliance on the contents of this site, or in connection with any failure of performance, error, omission, interruption, defect, delay or failure in operation or transmission, computer virus or line or system failure, even if Phytor, its representatives, are advised of the possibility of such damages, losses or expense, hyperlinks to other internet resources are at your own risk; the content, accuracy, opinions expressed, and other links provided by these resources are not investigated, verified, monitored, or endorsed by us. This exclusion clause shall take effect to the fullest extent permitted by law.

 11. Governing Law

By accessing this website and obtaining the facilities, products or services offered through this website, you agree that Singapore law shall govern such access and the provision of such facilities, products and services and you agree to submit to the exclusive jurisdiction of the Singapore courts.

 12. Third Parties Rights

A person who is not a party to any agreement governed by the Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act (Chapter 53B) to enforce any of the terms of such agreement.
